2.Service Description

Ignite Glowra provides professional software testing and debugging services to businesses and organizations in Thailand and internationally. Our services include but are not limited to:

• Functional and non-functional software testing
• Bug identification and documentation
• Debugging support and consultation
• Test automation development
• Quality assurance process improvement
• Performance and security testing

We strive to deliver high-quality services but do not guarantee that our testing will identify all defects or that our recommendations will solve all technical issues. Software quality depends on many factors beyond our control.

3.User Obligations

3.1 Lawful Use

You agree to use our website and services only for lawful purposes. You must not use our services in any way that violates local, national, or international laws or regulations.

3.2 Account Security

If you create an account with us, you are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access or security breach.

3.3 Prohibited Activities

You agree not to:

• Attempt to gain unauthorized access to our systems or networks

• Use our services to test software you don't have rights to test

4.Intellectual Property Rights

4.1 Our Content

All content on our website, including text, graphics, logos, images, documentation, and software, is the property of Ignite Glowra or our licensors. This content is protected by copyright, trademark, and other intellectual property laws.

4.2 Your Content

When you provide us with software, documentation, or other materials for testing, you retain all ownership rights. However, you grant us a limited license to use, analyze, and test these materials for the purpose of providing our services.

4.3 Deliverables

Test reports, bug documentation, and other deliverables we create during service provision remain our intellectual property until payment is received in full. Upon payment, you receive a license to use these deliverables for your internal purposes.

5.Confidentiality

We understand that you may share sensitive information with us during the testing process. We commit to maintaining the confidentiality of your proprietary information and will not disclose it to third parties without your consent.

Both parties agree to protect confidential information with the same level of care used to protect their own confidential information. This obligation survives the termination of our service agreement.

6.Payment Terms

Service fees are outlined in individual service agreements or proposals. Unless otherwise specified, payment is due within 30 days of invoice date. Late payments may incur interest charges at a rate of 1.5% per month.

We reserve the right to suspend services for accounts with overdue balances. All fees are non-refundable unless specifically stated in a separate agreement.

Prices are subject to change with 30 days' notice. Price changes do not affect services already under contract at the time of the change.

7.Service Level and Performance

We aim to deliver testing services within agreed timeframes. However, delivery schedules may be affected by factors including the complexity of software being tested, availability of necessary resources, and client responsiveness to queries.

While we employ experienced testers and follow industry best practices, we cannot guarantee that our testing will identify all defects. Software testing has inherent limitations, and some issues may only appear under specific conditions not covered in our test scope.

8.Limitation of Liability

To the maximum extent permitted by law, Ignite Glowra shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.

Our total liability for any claims arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim, or 50,000 Thai Baht, whichever is less.

This limitation applies to all causes of action, whether based on contract, warranty, tort, or any other legal theory. Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages, so these limitations may not apply to you.

9.Indemnification

You agree to indemnify and hold Ignite Glowra harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms of Use
• Your violation of any rights of another party
• Your use of our services in a manner not authorized by these terms
• Any content you provide to us that infringes intellectual property rights
• Your breach of any applicable laws or regulations

10.Termination

Either party may terminate a service agreement with written notice as specified in the agreement. In the absence of a specific agreement, either party may terminate with 30 days' written notice.

We reserve the right to terminate or suspend access to our services immediately, without notice, for violations of these terms or for any other reason we deem necessary.

Upon termination, you remain responsible for any outstanding fees, and we will return or destroy your confidential information as requested, subject to our legal retention obligations.

11.Data Protection and Privacy

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws, including Thailand's Personal Data Protection Act (PDPA) where applicable.

By using our services, you consent to our collection and use of your information as described in our Privacy Policy. We implement appropriate security measures to protect your data but cannot guarantee absolute security.

12.Governing Law and Dispute Resolution

These Terms of Use are governed by the laws of Thailand. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Lampang, Thailand.

Before pursuing legal action, both parties agree to attempt to resolve disputes through good faith negotiation. If negotiation fails, either party may pursue mediation before resorting to litigation.

13.Third-Party Services and Links

Our website may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of these third parties. Your interactions with third-party services are solely between you and that third party.

We may use third-party tools or services in delivering our testing services. We select vendors carefully but are not liable for issues arising from third-party service failures.

14.Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, war, civil unrest, government actions, labor disputes, power failures, or internet service disruptions.

The affected party must notify the other party promptly and make reasonable efforts to resume performance as soon as possible.

15.General Provisions

15.1 Entire Agreement

These Terms of Use, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and Ignite Glowra regarding the use of our services.

15.2 Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these terms or your rights under them without our written consent. We may assign our rights and obligations without restriction.

15.5 Language

These Terms of Use are written in English. Any translations provided are for convenience only. In case of conflicts between versions, the English version shall prevail.
